Art. 1 : General conditions of sale

The general conditions apply to any purchase made on the KWABO online shop via the website www.kwabo-reims.fr

The customer can read at any time the "General Sales Conditions" (GTC) by clicking on the GTC link at the bottom of each page.

By ordering on our site, the customer adheres, without exception, to all the clauses making up these GTCs.

The customer declares, by checking the box provided for this purpose before validating his order, that he has accepted these GTCs and therefore fully adhere to them.

These GTCs govern the relationship between the customer and KWABO. Only a written agreement signed by both parties containing special conditions may derogate from these GTCs.

The offers submitted by KWABO are reserved for the particular customers and for legal persons type companies, groups, under certain conditions detailed on a case-by-case basis in the offer.

Art. 2 : control

All orders are made at www.kwabo-reims.fr

The customer chooses his products and can find them in his online shopping cart. As soon as the customer considers that his basket is complete, he can place an order.

During the first use of the merchant site and after choosing its items, two options are offered to the customer:

  • Create a personal account to which it can log in with the email address and password it has set. The customer will be able to access his profile and his order history at any time on www.kwabo-reims.fr
  • Order in mode « invited » communicating only the information necessary for ordering and delivery, without subsequent interaction with Kwabo or subsequent use of his personal data. In this case there will be a single use of the data in the ability to perform the contract.

The customer will also have the choice to authorize Kwabo to send him promotional offers and newsletters.

The customer will have to certify his majority by checking the box provided for this purpose before accepting the GTCs. The acceptance of the CGV returns to the order and definitively validates the order.

KWABO SARL is entitled to ask the customer for proof of identity and domicile (extract K-bis, intra-Community VAT number for legal persons) to validate the order. In case of customer refusal or non-compliance of the parts, KWABO SARL may refuse and cancel the order.

If the customer does not wish to submit to this control, the latter remains free not to validate his order.

KWABO SARL is also entitled to cancel certain purchase orders if it considers after verification that the latter have different anomalies and irregularities (doubt on the customer's identity, usurpation, creation of irregular accounts etc.).

The invoice of the customer will appear in the parcel sent to the selected shipping address.

As provided for in article 2367 of the Civil Code, KWABO SARL is the sole owner of the articles put online until full payment of invoices.

The customer becomes owner and responsible for the items immediately upon delivery, the transfer of possession being risk transfer.

Art. 3 : methods of settlement and prices

Special case of bank transfer:

Bank transfer is a possibility offered by KWABO SARL in two cases:

 The client is a corporation type company, group

 The customer is an individual and carries out an order of more than 500€ TTC

In one of these cases, the order will be shipped upon receipt of the payment by bank transfer in order to ensure that both parties comply with the order.

  • Prices

Prices are expressed in Euros (€) and display all taxes included.

The price indicated on the product sheets is indicated excluding transport costs.

Transportation costs vary according to the mode of delivery chosen by the customer.

KWABO SARL reserves the right to change its selling prices.

All promotional operations (purchase vouchers, vouchers, partner discounts...) are limited to one person per household and per operation.

KWABO SARL reserves the right to refuse orders that do not meet this criterion.

Art. 4 : Delivery

Delivery is exclusively available in Metropolitan France.

Upon receipt of the order payment, KWABO SARL starts the transport and delivery operations. The goods ordered are delivered to the address indicated by the customer (delivery to the customer or at the point of withdrawal). The customer is responsible for the delivery information indicated. In case of error or lack of information resulting in a defect or impossibility of delivery, KWABO SARL will not be held liable. In case of return for incomplete address, the customer will have the possibility to change his address and to be sent back the goods by paying the new return fee.

Delivery cost

KWABO SARL offers its customers the choice of getting delivered at home or at a pick-up point. Depending on the choice made, the shipping costs are calculated at the time of the order, depending on the quantity desired and the place of delivery.

Art. 5: Transport responsibility

It is up to the customer to check the contents of the package at the time of receipt and to formulate reservations, if any, as follows: on the delivery slip provided by the carrier or by calling immediately the customer service of the carrier, in the presence of the delivery person. You are also requested to notify KWABO by RECOMMENDED LETTER addressed to its correspondence address (SARL KWABO – 31, rue de courcelles, 51100, REIMS) or byour contact formwithin 48 hours after receipt of your package.

Delays: KWABO undertakes to make every effort to deliver the products ordered as soon as possible. Delays vary depending on the product and mode of delivery chosen.

CAUTION: IN THE CASE OF DAMAGE OR CASE

IMPORTANT: The carrier is responsible for the conformity of the package during delivery.

It is up to the customer to verify the contents of the package at the time of receipt and to formulate precise and reasoned reservations stipulating the damage, if any, by entering them on the delivery slip or electronic box provided by the carrier. The customer also has the possibility to refuse the package if its compliance has not been preserved.

In any case, the customer must notify KWABO within 48 hours of receipt of the package byle contact form.

If all of the above conditions are met, KWABO SARL undertakes to offer a re-shipment, asset or refund to the injured customer.

Art. 6 : Stock and stock shortage

In the event of a stock shortage on a ordered product, KWABO SARL undertakes to keep informed as soon as possible and will offer the customer different alternatives:

– The replacement of the out-of-stock product by an equivalent or superior product under the same tariff conditions.

– Refund of the unavailable product(s) or the entire order according to the customer's choice.

In the event of a temporary stock shortage, the customer will be offered the choice to wait until the date of restocking. The customer will have the opportunity to accept and wait to receive all of his order, request partial or full cancellation of his order.

Art. 7: Commercial transactions and benefits

All promotional offers on the website www.kwabo-reims.fr are subject to special conditions. These operations can be associated with a defined duration, a limit of stock, availability, quantity. At the end of the supply, the products are likely to change prices. As a result, the customer takes advantage of this offer over a period of time and once the latter has expired, KWABO SARL cannot undertake to offer the same benefits to the customer on a future order.

Art. 8: Right of withdrawal

Conditions

The right of withdrawal is valid for 14 days upon receipt of the order (home or withdrawal point), without having to provide any justification. After this period, the right of withdrawal is no longer guaranteed.

The withdrawal period shall expire 14 days after the day on which the customer, or a third party other than the carrier and designated by the customer, takes physical possession of the property.

To exercise this right of withdrawal, the customer must notify KWABO SARL of its decision to withdraw by means of a precise and clear declaration (e.g. letter sent by post to SARL KWABO – 31, rue de Courcelles, 51100, REIMS, or e-mail viaour contact form).

In order for the withdrawal period to be respected, it is sufficient for the customer to send his or her mail relating to the exercise of the right of withdrawal before the expiry of the period of 14 days after receipt of the order.

The buyer renounces the benefit of Article 1587 of the Civil Code, relating to the approval and accepts any deviation within the limits of the analytical standards of the selected wine(s).

Effects of withdrawal

In the event of withdrawal from the customer, KWABO SARL will reimburse all payments received, including delivery costs. The costs of return are borne by the customer. Refund is made upon receipt of the package. The package must be returned to SARL KWABO – 31, rue de Courcelles, 51100, REIMS within 14 days of the date of your re-shipment.

Where certain products have been started or consumed, KWABO SARL reserves the right to deduct these products from the refund addressed to the customer.

Refund periods

In the event of a refund following a dispute, KWABO undertakes to reimburse to the customer the sum agreed with KWABO customer service without undue delay and not later than 21 days from the day on which it was agreed in writing to this refund with the customer service. All communications with the customer service will be made by email to the addresscommande@kwabo-reims.frorkwaboreims@gmail.com.

In the event of a refund following a return, the refund shall be made upon receipt of the package. For credit card refunds, interbank delays can shift the actual credit to the customer account by a few days.

Article 9: Protection of minors

The sale of alcohol is prohibited for persons under 18 years of age.

Upon registration, the customer will have to certify his majority. In addition, at each order, at the time of validation and before payment, the customer by accepting these GTCs will again certify his majority, by checking the box provided for this purpose.
